Terms & Conditions of Use and Services

The terms and conditions of use of our site are under review for translation accuracy purpose at this time.

Budget Digital Solutions Management

1.-Scope and limitations of responsibility of Budget Digital Solutions in relation to websites developed / managed + -

1.1.Responsibility for the integrity and correct functioning of the websites where Budget Digital Solutions carries out work

 

Budget Digital Solutions is fully responsible for the integrity and proper functioning of the website developed or managed that:

  • Budget Digital Solutions provides the hosting service.
  • Budget Digital Solutions has the exclusivity of all administrative access to the server and the website ( FTP, control panel, content manager, etc.)
  • Budget Digital Solutions assumes the administration of the web to perform updates and maintenance with the inclusion of periodic back ups.

In any other situation, we consider that the person in charge of the web is the client or who the / she designates for it.

 

–Responsibility for websites hosted on third-party servers (hosting service not contracted to Budget Digital Solutions)

When the client arranges and uses a hosting service contracted to third parties (not provided by Budget Digital Solutions), after finalizing and delivering or publishing any development or web programming work, we are not responsible for future failures, flaws or errors in the website, for whatever reason.

 

–Responsibility for the possession of access data to the server and the website administrator

When it is not possible for us to have exclusive access to the client’s server and the site administrator (content manager that is), we lose control over the integrity of the website in question and its proper functioning, and therefore we renounce any responsibility in this aspect.

Any intervention that is requested to us to repair eventual failures, errors or inconveniences, will have an extra cost.

In the case where the client assumes or has previously the administration of the website where Budget Digital Solutions performs any work, it must change all access passwords delivered to Budget Digital Solutions (after the final delivery of the work or the publication of the website).

 

– Guarantee and post-sale support of the integral web development service

Integral web development is considered to be the service of design and publication of a website, completely managed and executed by Budget Digital Solutions (without the intervention of programming or design services provided by third parties outside our company)

Within the terms of the service guarantee , all integral web post development support is free of charge when it comes to repairing errors or product failures attributable to our work.

 

– Backup and data backup policy

We also recommend making and maintaining updated back ups of the web sites or systems where third parties must access or work.

The client must always have under his / her power an updated backup of his / her website or contract a web administration service that includes the making of periodic back ups.

Budget Digital Solutions makes a back up of the websites developed at the moment of deliver the finished work to the client, but it should be considered that this initial back-up will not contemplate the subsequent updates of the website, so it is very important for the client to define and decide how he will manage his back ups, especially on websites that will be updated constantly and / or where the storage of data is critical.

In the event of an incidental incident that causes the loss (partial or total) of data or other resources owned by the client in the web server (hackers attack, hardware failures, etc. ), Budget Digital Solutions is not responsible. This includes both the website and any type of documentation / files hosted on the server.

 

1.2.Legal responsibility for the contents of websites developed or managed by Budget Digital Solutions

 

The client is the owner of the web site whose development or administration he entrusts to Budget Digital Solutions. From the legal point of view, the owner of the website is responsible for the contents and publications in it, as well as is responsible for compliance with the laws in force that regulate the uses and conditions of Internet sites, in those areas geographical where applicable.

 

1.3.Responsibility for the use of softwares, materials and web development supplies

The inputs of web site production: CMS softwares and extensions (web applications), multimedia materials of design and graphics, and in general any resource used in web development, also have normative specifications on use and licenses, copyrights , the compatibility of the same, the scope and guarantees of the products, etc.

2. Terms and conditions of web design / re-design services, programming and development + -

2.1. Integral services of web development and its scopes

The integral services of web development are those services of design or re-design web where Budget Digital Solutions solves all the aspects and necessary services to publish the website and deliver it to the client as “turnkey”

 

In the comprehensive web development services we assume that what is not explicitly detailed included in the proposal and budget sent will NOT BE INCLUDED in the work to be done, except when the client requests his/her requirements with the provision of paying an extra charge, in case that was applicable

2.2. Linking web design services with hosting services and domains:

In the event that the client contracts web design services jointly with our webhosting service and / or domain management, you must also agree and accept the terms and conditions of said services at the moment of contracting them.

  • Terms and conditions of services of registration and administration of Internet domain names
  • Terms and conditions of services of web-hosting or hosting of web sites

 

2.3. Particular conditions expressed in the web development proposals and budgets.

 

Proposals and budgets sent to the client include clauses and particular conditions, including:

– Deadlines for delivery of materials and content by the client counted from the effective hiring of the service

– Expiration deadlines for budgets and proposals

– Offers and promotional codes applicable to the contracting of the service, with expiration date

– Deadlines to make the corresponding payments and their means

– Responsible for projects (from Budget Digital Solutions and the client)

– Items and services included in the budget

– Resources and materials that the client must provide and resources that must be developed / provided by Budget Digital Solutions as part of the service

– Credits of the development work and / or mentions in the Budget Digital Solutions portfolio

– Licenses for the use of copyrighted materials (from author’s rights)

– Guarantees, limitations and scope of the products, resources, and softwares used for the provision of the service

– Maximum allowed amount of revisions / corrections to the deliverables and their level of complexity allowed- Guarantees, limitations and scope of the works or services performed

– Conditions to regulate the non-fulfillment of the deliverables (by both parties: Budget Digital Solutions and the clients)

– Deadlines for corrections and revisions of deliverables

– Deadlines for completion and project delivery

– Other conditions agreed upon

 

2.4. Ownership of developed websites and legal responsibility

The customer is the sole owner of its website and responsible for its contents and publications in it, as well as is responsible for compliance with the laws in force that regulate the uses and conditions of sites. Internet, in those geographical areas where applicable. The Copyright Budget Digital Solutions should always be reserved! Unless I’m going to negotiate it!

 

2.5. Credits for web development services

Except in cases where another condition is exceptionally agreed, web sites developed 100% by Budget Digital Solutions will bring a small link to the footer to https://www.budgetdigitalsolutions.com on title “Powered by Budget Digital Solutions”

If the client wishes not have this link and credit on your website you must notify us BEFORE hiring the service, but this waiver will represent an increase of 20% to the total cost of our fees, expressed in the development budget.

Mention in the Budget Digital Solutions portfolio: Except in In cases where another condition is exceptionally agreed, our works are published in our “Portfolio of clients”.

Any client that does not wish to be incorporated into our website, must notify BEFORE hiring the service, and this resignation will represent an increase of 20% to the total cost to be paid expressed in the development budget.

 

2.6. Guarantees, Scope and Limitations of the integral web development work

 

We guarantee the correct and total functioning of our websites developed for a term of 1 year, provided that:

  • They are hosted on Budget Digital Solutions web servers. When the client uses a hosting service contracted to third parties, unrelated to Budget Digital Solutions or their own hosting / housing solution, the warranty expressed here is invalid.
  • Budget Digital Solutions has developed and managed 100% of the project’s work, without others third parties involved in development that do not belong to the staff or are partners of Budget Digital Solutions.
  • Budget Digital Solutions have the exclusivity of the accesses to the web server and the administrator of the CMS. When Budget Digital Solutions delivers access data to the server and / or administrator of the content management system, the aforementioned guarantee is invalid. This is because when you send Budget Digital Solutions the access data to the client, you lose total control over the work / service delivered, and therefore renounces your full responsibility.

 

When the client wishes to manage his own website, he assumes that any inconvenience, failure, or problem subsequent to the delivery of the corresponding accesses, is at your own risk. The requests of technical interventions to Budget Digital Solutions for repair or solution to failures will be charged separately.

2.7. Soporte post-venta del servicio de desarrollo web

Dentro de los términos de la garantía del servicio, todo soporte post venta sin cargo estará estrictamente limitado a reparar errores o fallos del producto atribuibles a nuestra responsabilidad.

Una vez entregado el sitio web al cliente (finalizado el servicio de desarrollo), cualquier solicitud posterior representará la contratación de otro servicio.

Todo soporte y asistencia posteriores que el cliente solicite para actualizar, mantener, administrar, ampliar o modificar el sitio web desarrollado o sus servicios asociados, serán cobrados aparte SIN EXCEPCIÓN.

3. Service of Administration / Maintenance of web sites and technical interventions + -

Budget Digital Solutions offers two services to solve the maintenance and administration of the websites delivered to the client:

  • Specific interventions
  • Monthly management plans

We call “intervention” any kind of task requested to Budget Digital Solutions that requires up to half an hour of work. Each intervention has the same cost regardless of whether it takes 10 minutes or half an hour. In addition, an intervention is considered for each request. (more information)

Intervention requests will be answered within 24 business hours. On Saturdays, Sundays and holidays we do not provide support except for extreme emergencies.

The monthly maintenance service is prepaid (paid by month in advance). The assigned monthly time that is not used is not cumulative and expires month by month. We will not consider granting a subsequent credit applicable to future periods for the “non-use of the service” during the contracted period.

When web updates are requested, the contents must be provided by the client.

 

Web maintenance does not include:

1) Image editing to be published

2) Writing, revision, or correction of texts

3) programming, coding, layout, installation of scripts, or design.

These services are quoted separately.

4. About the works of design, development, and programming, hired by the hour + -

The service must be contracted only after having confirmed the availability and qualification of Budget Digital Solutions to carry out the work that will be done or developed

Request procedure

The client must send a complete, exhaustive and precise written detail of their requirements, specifying in addition the work to be done, the url address of the website and its corresponding access. You must also submit any resource, material, content, files, or software necessary to perform the tasks ordered.

Once we evaluate the request, if the service is viable, we estimate the amount of hours necessary (approximate) to be contracted. the client to carry out the tasks ordered.

If the client agrees, he can proceed with the purchase and the payment of the same. Once this is done, the service begins to be offered.

The pack of contracted hours has a valid month

The pack of hours purchased in each contract must be used within a month. After this period, the credit for the remaining unused time automatically expires (unless a delay is requested in advance for the use of the remaining time, justifying the reasons for the request)

 

Job timing

The chronometrization of each intervention / work includes (in addition to the actual development or programming works): the interaction by email between Budget Digital Solutions and the client or any type of support / assistance, the search and acquisition of resources or information by Budget Digital Solutions, the interactions or negotiations between Budget Digital Solutions and third parties involved in the client’s project, and in general any type of management that is necessary to comply with the work commissioned by the client

 

Mode of payment

The hirings are in prepaid mode. At the moment of exhausting the credit paid (the hours of work purchased), we will notify the client that he / she must contract / pay another pack of hours to continue the work. Until this happens, any work or intervention will be interrupted

This hourly payment service does not allow the refund of money paid, for any reason.

 

Volume of contracted hours

After understanding and knowing the complete requirements of the client, Budget Digital Solutions suggests to him the approximate amount of hours he needs to hire to solve and carry out the requested work. However, a priori estimates may have a margin of error, giving rise to two possibilities:

that there is some remaining time at the end of the requested work, or

that the time contracted to complete it is insufficient (if the client on the fly adds tasks or modifies previously defined issues for the work commissioned).

In the first case, the remaining hours or unused time will be taken as credit for subsequent requests (within the term of the service). In the second case, we will recommend the client to hire more hours of work to complete the tasks assigned.

The assessment of the performance / effectiveness of the work carried out, as well as the degree of compliance according to the hours contracted, is at the discretion of the client requesting the service.

5. About software and other web development resources + -

5.1. Software system for website development

Websites developed or built by Budget Digital Solutions use Open Source platforms, such as: Joomla! ™ CMS, WordPress, CakePHP, Croogo CMS on CakePHP, Symfony2, Java RD2, among others.

5.2. Data access to the web server

When the client uses the hosting service provided by third parties, or alternatively has his own host solution, he must provide Budget Digital Solutions with the following information:

– Accesses by FTP

– Accesses to the web control panel (Cpanel, Plesk, etc), and / or MySQL database administrator PHPMyadmin

Only when we can make sure that the accesses (to the web server and / or CMS administrator) are restricted exclusively to Budget Digital Solutions, we can take full responsibility for the integrity and perfect functioning of the web / system.

Faced with another situation, after finalizing and delivering any development or programming work done on the client’s server, we are not responsible for future failures, flaws or errors on the website.

For this reason, at the end of our work, the client must change all access passwords to exclude our responsibility. We also recommend making and maintaining updated back ups of the web sites or systems where third parties must access or work.

6. Terms and conditions of consulting services, support, or online training: + -

6.1. Consulting, support and assistance by E-mail:

To take the consultancy by email, it is necessary to accept these terms and conditions of service:

Each hour hired in this modality has a minimum fractionation of 15 minutes to perform each intervention or support session

A session or intervention includes: reading and interpreting each email message with the queries, and then researching, preparing / writing and sending the message with the pertinent answers to the queries. Any other type of work / intervention is timed and charged

Minimum packs of two hours of support or assistance (to be used in a maximum of one month) are contracted in prepaid mode. At the moment of exhausting the credit subscribed, another hiring and prepayment of two hours (monthly) must be done so that the consultancy can continue to be provided, without interruptions.

In each contract hours purchased support / consulting must be used within a period of one month from the time of recruitment, expired this period, the service not used (either fully or partially) automatically expires without possibility of refund of money paid

7. Terms and Conditions of the Online Marketing service + -

7.1. Requirements for hiring

  • If you wish to advertise in search engines you will need to have active accounts in Google Adwords and / or Yahoo! Search Marketing, or have the means of payment required to subscribe to these programs. To subscribe to the services of Google and Yahoo!   • We do not accept the following types of websites: horizontal / generalist portals, online journals, online magazines, adult content sites, blogs, online community sites or networks sociales
  • This service is not interchangeable or re-saleable. We need direct contact with the final client or a responsible of the business / company to promote

 

7.2. Guarantees and expected results of the proposed service

The evolution and impact of our efforts will be monitorable through a statistical system beyond our control, provided by a third party (Google Analytics)

We assume an ethical and professional commitment taking responsibility for each project and management, demonstrating through a written report the work done in each monthly period.

We will not practice black hat SEO techniques (cheats to the search engines or practices not allowed that would put in risk the reputation of your web in front of the search engines)

 

On the guarantee of success of the online marketing plan:

We guarantee the quality of our work, as well as the methods and routines used, but we can not guarantee favorable results nor the expected success.

The success of the campaign also depends on factors beyond the control of our management.

This limits our responsibility, and as a consequence we do not commit ourselves to achieving quantitatively defined objectives a priori. Some variables beyond our control are:

  • Changes in Internet competitiveness levels for your business, industry, or products (this also includes the available offer of your competitors)
  • Changes and trends in demand levels -on the Internet- for your products or services (temporarily variable or not) the effectiveness of the online sales force of your company / site (how efficiently, quickly and professionally you respond / respond to requests from your website)

7.3. Hiring and service payments

  • There is no contractual obligation of minimum period in the contracting of the service. You can stop the contract at any time. Assigned work hours

During each monthly work period, you contract a limited number of hours

These contracted hours will be used by the professional in charge of the service for any task related to your project, which may be: website optimization, editing of html pages and forms, software installation / configuration, link exchange management , subscription to directories and other online media, generation and publication of content, administration of Adwords or Yahoo! Search Marketing, analysis of key terms and results, advice that we provide you via email or MSN Messenger, writing and sending weekly reports, etc. In general, everything that takes time we count in the hours contracted.

To determine the appropriate option of monthly hours. There is no exact way of calculating a priori the quantifiable results in relation to the hours of work consumed, since there is a direct relationship between the volume of work and the magnitude of its derived benefits, BUT there is no easy way to know in advance how much work is necessary to achieve certain predefined objectives.

For this reason, the monthly investment level (number of hours hired) is chosen by you according to your budgetary possibilities and the scope of your objectives. You can alter during the course of the plan, the number of hours of management, that is to say change of option on demand.

8.1. Client account management associated with your domain (s)

The purchase / registration of domains provided by Budget Digital Solutions and its subsequent administration, is done through our customer account system, located at http://www.budgetdigitalsolutions.com

Real data of the owner of the domain

The data registered by the client at the time of purchase of domains must be real (see our data privacy and confidentiality policies). We reserve the right to suspend customer accounts in which false data are detected, as this goes against the laws in force regarding the registration of domain names.

E-mail linked to domain administration

Any notification from Budget Digital Solutions to the client in relation to the domain service (payments, expirations, renewals, data updating procedures, legal notices, etc.) is made through the email address registered in our system. It is the responsibility of the client to keep this information updated to ensure that it will correctly receive the important notices that require actions necessary for the conservation and correct management of the domain names.

Use of strong passwords

It is the client’s responsibility to keep the access data to their account and the management of the contracted services safe and far from the reach of third parties. Additionally, the passwords used must be marked as “safe” (strong) by the system, at the time of generation or change. The inappropriate use of access passwords (use of easily vulnerable passwords or the disclosure thereof) that leads to possible violation or access by unauthorized third parties is the responsibility of the client.

 

8.2. Disclaimer of domain names

Budget Digital Solutions is not responsible for domains registered and managed by other registrars (companies) when these domains are linked to services provided by Budget Digital Solutions, eg: hosting, web maintenance, etc. It is necessary for us to assume the absolute responsibility to transfer the domain (s) in question to our registrar.

We assume no liability or obligation in relation to domains whose administration is the responsibility of the client. In this case, the client is solely responsible for his / her domain / s before: renewals, expirations, delegations, change of data, contact and billing data updates, blocking, and in general, any option, service, management and configuration of / the domain under his charge.

The improper use of domain names for the publication of websites with illegal content will imply the automatic suspension of the service, and will initiate the corresponding legal actions against the offenders.

8.3. Expiration of registration of paid domains

The payment of domain renewals and the corresponding notification to Budget Digital Solutions must be made at least 5 business days prior to expiration.

In case of having the service default on the expiration date of the domain in question, it will be automatically deactivated, with the consequence that the associated website will be unfailingly offline (offline), until the domain service is renewed and paid.

 

Expiration and domain name cancellation process

The expiration of domains follows the following cancellation process:

1- STATUS “ON HOLD” (grace period)

Domains registered or transferred to Budget Digital Solutions that expire are given a 29-day grace period for renewal. During this period the cost of renewal is not altered, and can only be renewed by the owner of the Domain.

Budget Digital Solutions does not offer guarantees regarding this grace period, since our provider (ENOM INC, accredited first-order registrar and authorized by ICAAN) does not offer them either.

It is the sole responsibility of the owner of the domain to contact Budget Digital Solutions by email or telephone to ensure that their domain will be renewed correctly, eliminating the risk of losing it.

2- STATUS “REDEMPTION TIME” / RGP (redemption period)

This period follows the previous status and lasts approximately 30 days. The client must take into account that:

To renew the domain and restore ownership to the original owner, the cost may exceed the sum of $ 200 (ICANN administrative fee) + $ 50 (administrative fee of the registering company)

in this status there is the possibility that any third party can register the domain

3- STATUS “PENDING DELETE” (pending deletion)

This period begins 5 to 6 days after the end of the previous status. After the elimination period, the domain is released so that any person can register / buy it through any registrar.

In this period it may still be possible to be recovered by the original holder, with the price of the previous status (redemption period)

9. Terms and conditions of the web-hosting service or website hosting + -

9.1. Scope of service support

The hosting service is self-managed, from the control panel provided by Budget Digital Solutions (Cpanel). The administration of the services under the account contracted in the web server is the responsibility of the client, who will be able to manage all maintenance tasks and configurations from his Cpanel control panel, and making use of the guides that we provide for that purpose.

The free support on the service is limited only to provide assistance with problems specific to the web server and does not include any task or specific management of configuration or maintenance of the account.

Tasks and management of extra payment in the hosting service (not included in the annual payment of the service)

When the client requests it, the following tasks have a cost per intervention of Budget Digital Solutions (unless a monthly maintenance plan is contracted):

Change / reset of access passwords to Cpanel or email accounts

Creation / deletion / redirection of email accounts and configuration of email / webmail options

Cleaning and freeing of disk space or control of disk space / monthly transfer

Realization of Back ups or restoration of them.

In general, any intervention in Cpanel has a cost per task requested

9.2. Undue use of the hosting service

The inappropriate use of the web server is not allowed. It should be understood by “inappropriate use” that includes at least some of the practices or uses that we detail below:

SPAM E-mail Spaming is not allowed. This is the sending of junk mail.

Illegal contents. Sites that violate legal laws, or are morally undesirable: Eg Pedophilia, illegal trafficking of prohibited goods, illegal businesses, advocacy of discriminatory ideologies, etc.

Hacking practices. It is not allowed to use our server as a means of: automated web scanning, spoofing, hijacking, exploiting, DOS (denial of service), sniffing, or other known techniques of illegal data intrusion or property owned by third parties. It is not allowed to host, nor use scripts (such as backdoors, Trojans), and in general any software program that accesses other domains / web servers with the aforementioned purposes.

Excessive use of server resources. This includes processes that overload the CPU and make excessive use of its RAM, by the use of poor software programs, or non-optimized databases.

Third party copyrighted material: It is not allowed to host pirated software or digital material with copyright in the web server, when you do not have the appropriate permission to use and exploit it.

As a general rule, any practice or improper use of the service that harms our server or third parties is not allowed.

Faced with the violation of these conditions or misuse detected in accounts hosted on the server, the service is automatically terminated, without the client’s right to demand refunds or refunds of their money.

9.3. Backup of files and data of property of the client in the web server.

It is the responsibility of the customer of the service to maintain and safeguard in its power BACK UPS complete and updated with the information, data, and files housed in the server. In general, this applies to any resource / configuration hosted on the server, owned by the client.

In case of any loss or corruption of files or data, partial or total, whatever the cause, it will not fall on the responsibility of the provider of the service (Budget Digital Solutions) the recovery of resources or material lost and / or damaged. Additionally, the client can request a monthly back-up service from Budget Digital Solutions, to ensure the integrity of the files and / or website hosted.

9.4. Conditions of withdrawal in the hosting service

The client can request the withdrawal of the service at any time, but will not be entitled to demand refunds or refund of money for the remaining unused period of the service.

Before the service is terminated by the client (or due to lack of response to expiration messages), the customer is the only responsible to recover all configuration, data and files hosted on our web server, available in the Cpanel control panel associated with his account. With this you will have at your disposal everything you need to be able to start the migration of your site / web system and other resources of your property to a new server (hosting provider)

The steps and work necessary to migrate resources owned by the client (site web, data, email accounts, files, and server configurations) from our web server to another managed by third parties unrelated to our company, is the responsibility of the client.

Any intervention requested from us to perform the management or migration work towards another Web server will be budgeted and charged to the client.
